Privacy Policy
The Nation of Size, LLC (“NOS”) recognizes the importance of protecting the privacy of information belonging to users of our site (the “Users”), at www.nationofsize.com (the “Site”). The following discloses our information gathering and dissemination practices for the Site.
This Privacy Policy is incorporated into and is subject to the NOS’s Terms of Use. Your use of the Site and any personal information you provided on the Site remains subject to the terms of this Privacy Policy and our Terms of Use.
Please note that any video, image, photos, or other content posted voluntarily by the Users onto the Site becomes published content and is not considered personally identifiable information subject to this Privacy Policy.
1. The information we collect
User Provided Information: at the time you sign up as a member of the Site you will be asked to provide us with your personally identifiable information (name and e-mail address), username, city, state, zip code, gender and your relation to a person-of-size (if provided). When you enter sweepstakes and/or contests sponsored by NOS, as a condition to awarding you with the prize we may ask you to provide us with your personal and shipping addresses.
User Provided Information Regarding Third Party: at the time you sign up as a member of the Site you may choose to provide us with the e-mail address of a friend whom you wish to invite to NOS;
Questionnaires and Surveys: we may offer on the Site, optional questionnaires and surveys to for such purposes as collecting demographic information or assessing Users’ interests and needs. We may post the results of such questionnaires or surveys, in the aggregate on the Site, without any personally identifiable information. If we collect personally identifiable information from our users in these questionnaires and surveys, the users will be given notice of how the information will be used prior to their participation in the survey or questionnaire.
Cookies: as part of our service, we use cookies to store and sometimes track information. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Site may not function properly if the ability to accept cookies is disabled.
Log File Information: when you use the Site, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, referring/exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.
Web beacons: or clear gifs, are small pieces of code which we place on a web page to monitor the behavior and collect data about the visitors viewing a web page. In addition, we may also use clear gifs in HTML-based e-mails sent to our Users to track which e-mails are opened by recipients.
2. How we use information
User Provided Information: we use your e-mail address to notify you of updates to the Site and periodically send out e-mail and/or newsletters to you about our activities. We may use your e-mail address to deliver information to you that, in some cases, is targeted to your interests, such as product or service offerings. You will be given the opportunity to opt out of such product or service offerings on each such mailing. We will not sell, share or rent your e-mail to third parties for e-mail promotional purposes. We use your demographic information (city, state, zip code, gender and relationship to person-of-size) to improve our marketing and promotional efforts, to statistically analyze site usage, to improve our content and product and service offerings and to customize the Site’s content, layout and services. We will use your personal and shipping addresses for the purpose of awarding and delivering the sweepstake and/or contest prize to you. Your username will appear under messages posted by you on the message board and may appear under videos, images, photos or other content submitted by you. Should you become a winner of one of the sweepstakes and/or contests sponsored by NOS, your name will appear on the winner’s list for that particular sweepstake or contest which may be posted on the Site and/or made available to the public through other means as required under applicable laws.
User Provided Information Regarding Third Party: we use the e-mail address of your friend provided by you to us ONLY to send a one-time electronic invitation to such friend to visit the Site.
Cookies, Web Beacons and Log File Information: We use cookies ,web beacons, and log file information to: (i) remind us who you are and enable us to access your account information so you do not have to re-enter it; (ii) provide custom, personalized content and information; (iii) gather statistical information such as total number of visitors, pages viewed, etc.; (iv) monitor effectiveness of our marketing campaigns and ; and (v) track your entries, submissions, and status in promotions and contests.
Information That Is Voluntarily Disclosed: Please be advised that any personal or non-personal information which you voluntarily disclose online (on message boards, in messages and chat areas, within your public profile page, surveys & questionnaires, etc. becomes publicly available and can be collected and used by others. Your username (not your e-mail address) is displayed to other users when you upload videos, photos or send messages through the Site. Any videos, photos or messages that you submit to the Site may be redistributed through the internet and other media channels, and may be viewed by the general public.
NOS may release User Provided Information which includes, personally identifiable information (name, e-mail and physical addresses) if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright law) or respond to a court order, subpoena or search warrant. NOS also reserves the right to disclose User Provided Information which includes, personally identifiable information (name, e-mail and physical addresses) that NOS believes, in good faith, is appropriate or necessary to enforce NOS’s Terms of Use, take precautions against liability, to investigate and defend itself against any third party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Site, and to protect the rights, property, or personal safety of NOS, our Users and others.
3. Your Options
You may, of course, decline to submit User Provided Information and/or User Provided Information Regarding Third Parties through the Site, in which case NOS may not be able to provide certain services to you. You may update or correct your User Provided Information at any time by visiting your account profile page. Please note that any content uploaded by users to the Site remain subject to our Terms of Use.
To protect your privacy and security, we take reasonable steps (such as assigning to you a unique password which you can reset by visiting your account profile page) to verify your identity before granting you profile access or making corrections. You are responsible for maintaining the secrecy of your unique password.
4. Third-party Advertising
NOS allows other companies, called third-party ad servers or ad networks, to serve advertisements within the Site. These third-party ad servers or ad networks monitor user’s response to ads, and they may also collect non-personal information through the use of cookies, Javascripts or web beacons on the Site. In certain situations, information collection may be facilitated by momentarily directing your browser to the web site of an ad server or other third party acting on behalf of the advertiser before re-directing your browser to its selected destination; this re-direction process will not be apparent to you. NOS does not provide any personally identifiable information to these third-party ad servers or ad networks. You should review the privacy policy of other sites you visit or link to from the Site to understand how these other sites use cookies and how they use the information they collect through the use of cookies, Javascripts and/or web beacons on their own sites. NOS’s Privacy Policy does not apply to, and we cannot control the activities of, such other advertisers or web sites.

5. Policies for Individuals Under 13
We have no way of distinguishing the age of individuals who access our website, and so we carry out the same Privacy Policy for individuals of all ages. If a child has provided us with personal-identifying information without parental or guardian consent, the parent or guardian should contact us to remove the information and opt out of promotional opportunities.
6. Third Party Websites and Practices
We are not responsible for the content or the privacy polices of websites to which we may provide links. The privacy policy of such third party website may differ from ours. We encourage you to read that policy before responding to the offer.
7. Our commitment to data security
To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.
If NOS learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. NOS may post a notice on the Site if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive a free written notice of a security breach (or to withdraw your consent from receiving electronic notice) you should notify us at legal@nationofsize.com.
8. Special Note to International Users
The Site is hosted in the United States and is intended for and directed to Users in the United States. If you are a User accessing the Site from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of the Site, which are governed by U.S. law, this Privacy Policy, and our Terms of Use, you are transferring your personal information to the United States and you consent to that transfer.
9. In the Event of Merger, Sale, or Bankruptcy
In the event that NOS is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors rights generally, we may not be able to control how your personal information is treated, transferred, or used.
10. Notification of Changes
This Privacy Policy became effective as of the date indicated below. Any significant or material changes to our Privacy Policy will be communicated through our website at least five (5) days in advance of its effective date. Information collected before changes are made will be secured according to the previous Privacy Policy.
